Email Ideas, LLC Terms and Conditions of Service

Email Ideas LLC agrees to provide services to Customer, subject to the following Terms and Conditions:

1. Payments and Refunds: Payment for Email Ideas Bojos can be made after Customer has inspected the Bojo through our 7 day free trial.  Customer has seven (7) days to use the Bojo to confirm the Bojo works as expected in Customer's email environment prior to purchase. The Company will refund Customer's Bojo within thirty (30) days of payment for any reason. Payments recur annually and are paid via an automatic subscription through our merchant account.

2. Support: Phone support is offered to paid Bojo customers who purchased prior to February 2010 at no additional charge.  Customers who purchased a bojo after February 2010 are entitled to email support or may purchase phone support for $25.

3. Marketing: Customer grants Company the right to display Customer's bojo on the Company's user activity maps.

4. Lawful Use: Customer may only use the EmailIdeas.com products, networks, computers, software and/or other services for lawful purposes. The Customer agrees to indemnify and hold the Company harmless in any claims resulting from the Customer’s use of the Company's services which damages the Customer or another party.

5. Offensive Use: Customers may not display any content or information or provide links to offensive material of any kind.  The Company reserves the right to remove any material we deem to be offensive.

6. Warranty and Liability: Email Ideas, LLC makes no warranties of any kind, whether expressed or implied, for fitness or merchantability of any services or products it supplies. Email Ideas, LLC shall not be liable for any loss of profits, loss of use, or indirect, special, incidental or consequential damages of any kind in connection with or arising from Email Ideas, LLC furnishing or failing to furnish services, equipment, material or advice of any kind. Email Ideas, LLC’s maximum liability regardless of the form of action taken shall not exceed the charges paid by the Customer.

7. Copyrights and Trademarks: Customer represents to Email Ideas, LLC and unconditionally guarantees that any elements of text, graphics, logos, photos, designs, trademarks, or other artwork used on the Customer's Bojo or website are owned by Customer, or that Customer has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Email Ideas, LLC and its subcontractors from any claim or suit arising from the use of such elements furnished by Customer.  Customer agrees to display the Email Ideas, LLC copyright notice with a link to the emailideas.com website.  This copyright notice can only be removed if the Customer has purchased a right to private labeling from Email Ideas, LLC.

8. Design Credit: Customer's Bojo will contain a link to the EmailIdeas.com website. Customer agrees that Customer's Bojo may be included in the Company's portfolio. If Customer wishes to purchase a private label Bojo, Company will provide pricing details for this service.

9. Software and Licensing: Software used to create Customer’s Bojo is owned by Email Ideas, LLC.

10. Breach of Agreement: Email Ideas, LLC reserves the right to cancel accounts and terminate services if the Customer is found in breach of these Terms and Conditions of Service.
